Acceptance

By creating an account or otherwise using LivePersona ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

Service Description

LivePersona generates an AI-animated avatar from a single photo you provide and supplies a virtual-camera stream you can broadcast through OBS to live-streaming platforms such as TikTok. The Service also provides scheduling, clip capture, and analytics tools. We may add, modify, or remove features at any time.

Account Responsibilities

You sign in to LivePersona using a passwordless magic link sent to your email. You are responsible for keeping access to that email account secure. Anyone who can receive your magic-link emails can sign in as you. You agree to provide a valid email address and to notify us promptly if you suspect unauthorized access to your account.

Acceptable Use

You agree not to use LivePersona to:

Produce, stream, or distribute content that is illegal in your jurisdiction, that depicts non-consenting individuals, or that targets minors in a sexual or exploitative manner.

Impersonate any real person other than yourself. Your avatar must be derived from a photo of you, or of someone who has consented to having their likeness used in this way.

Violate the Terms of Service of any third-party platform you stream to via LivePersona (for example, TikTok or YouTube). Misuse of those platforms is your responsibility, not ours.

Reverse-engineer, scrape, or attempt to extract our source models, prompts, or generation pipeline, or interfere with security or rate-limiting mechanisms.

Subscriptions & Billing

LivePersona offers three tiers. The feature list below mirrors the live Stripe pricing page.

Starter ($29/month) — 1 platform of your choice, 5 streams per month, basic analytics, community support.

Agency Starter ($79/month) — all platforms, unlimited streams, full dashboard, advanced analytics, priority support.

Agency Scale ($199/month) — everything in Agency Starter, plus team access, multiple avatars, white-label options, and dedicated support.

All paid plans are billed monthly via Stripe and auto-renew each billing period until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you retain access to your plan's features until then. We do not provide refunds for partial billing periods except where required by law.

Intellectual Property

You retain ownership of the photos you upload. By uploading a photo, you grant LivePersona a limited license to process it for the purpose of generating and storing your avatar. You retain the right to use the generated avatar assets for your own streams and content.

LivePersona retains all rights to the platform itself — the website, the generation pipeline, the UI, the brand, and any aggregated, de-identified service data. You may not copy, resell, or sublicense the Service.

Termination

You may delete your account at any time. We may suspend or terminate your access if you breach these Terms, if continued provision of the Service would create a security or legal risk, or if we discontinue the Service. Upon termination, your uploaded photos and generated avatar assets will be deleted in accordance with our retention practices.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated avatars will be indistinguishable from real humans, nor that any particular streaming outcome (followers, virality, monetization) will result.

Limitation of Liability

To the maximum extent permitted by law, LivePersona's total liability arising out of or related to your use of the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim, or one hundred US dollars, whichever is greater. LivePersona is not liable for indirect, incidental, special, consequential, or punitive damages.

Governing Law

These Terms are governed by the laws of [GOVERNING_LAW_STATE], United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in [GOVERNING_LAW_STATE], and you consent to personal jurisdiction there.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will provide additional notice (such as an in-app banner or email) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
